What Does a Process Server Do?

A process server is a person who delivers legal documents, such as subpoenas, summons, complaints, and other court papers, to individuals involved in a legal proceeding. Their role is to ensure that those involved are properly notified of their legal obligations or actions being taken against them. Once the documents are served, the process server provides proof, typically in the form of an affirmation of service, confirming that the papers were successfully delivered in accordance with legal requirements.

As of January 1, 2024, a recent amendment to CPLR 2106, signed by Governor Hochul, now permits process servers to affirm their statements, including affidavits of service, without requiring notarization. In line with this change, we will be affirming all documents. If you prefer a notarized affidavit, please let us know, and we will provide it upon request.


Understanding Personal vs. Non-Personal Service

In legal proceedings, documents must be delivered in a manner that ensures the recipient is properly notified. This process generally falls into two categories: personal service and non-personal service.

Personal Service requires the documents to be handed directly to the individual named in the documents. This approach is used when it is essential to confirm that the person has received and acknowledged the paperwork, as is often the case with sensitive or time-sensitive matters. Examples include family court papers, divorce filings, and certain subpoenas, where a direct handoff is necessary to fulfill legal requirements. Personal service provides a higher level of assurance, as it involves face-to-face interaction, allowing the server to verify the recipient’s identity.

Non-Personal Service, by contrast, allows documents to be delivered to someone other than the named individual or through alternative methods, such as mail. This type of service is typically sufficient for cases where direct acknowledgment from the recipient is not legally required. Commonly used in landlord-tenant disputes and other civil matters, non-personal service may involve leaving the documents with another resident at the recipient’s home, a colleague at their place of business, or by mailing the documents to their last known address. This method is often quicker and can be more practical when the recipient is unavailable or difficult to reach directly.
