What Does a Process Server Do?

A process server delivers legal documents, ensuring proper notification in legal proceedings. This includes subpoenas, summons, complaints, and other court papers. Our team ensures compliance with legal requirements, providing proof of service through affirmations.

New Legal Update: As of January 1, 2024, a recent amendment to CPLR 2106, signed by Governor Hochul, now permits process servers to affirm their statements, including affidavits of service, without requiring notarization. In line with this change, we will be affirming all documents. If you prefer a notarized affidavit, please let us know, and we will provide it upon request.

Personal vs. Non-Personal Service

Personal Service involves directly handing documents to the named individual, ensuring acknowledgment. Examples include family court papers and divorce filings.

Non-Personal Service allows delivery to another person or via alternative methods, such as substituted service or tack-and-mail. Common in landlord-tenant disputes, this method ensures timely notification when direct contact isn’t feasible.

Our Services and Pricing

Standard Turnaround Time: The standard turnaround for service is 4-7 days. Expedited service options are available upon request but must be confirmed and are not guaranteed.

Additional Mailing Costs: Services that require mailing will incur additional charges to cover postage and processing fees. For new clients who must pay in advance, the mailing cost will be estimated upfront based on the location and number of documents. Any significant differences will be communicated and adjusted appropriately.

Non-Personal Service Details: Non-personal serves include three attempts to deliver the documents.

Notice of petitions and petitions will be mailed directly to the court to ensure compliance with court-specified time requirements.

Subpoena Checks

Checks for subpoenas will be included with the service unless specified otherwise. This ensures compliance with New York State requirements, as failure to include payment constitutes defective service. Applicable rates are $15 per diem and 23 cents per mile for New York State, and $40 per diem and 0.655 cents per mile for federal subpoenas. Mileage is not always required, as it depends on whether travel reimbursement is applicable. For more information, refer to CPLR 8001 and FRCP Rule 45.
